You can get one from birth, up until the age of 25.<\/p>\n\n\n\n<p>EHCPs set out:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-secondary-bullets\">\n<li>The child or young person\u2019s educational, health and social care needs.<\/li>\n\n\n\n<li>The extra support they will get to meet those needs.<\/li>\n\n\n\n<li>How that support will enable them to achieve what they want in life.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"standfor\"><strong>What does EHCP stand for?<\/strong><\/h3>\n\n\n\n<p>EHCP stands for \u201ceducation, health and care plan\u201d.<\/p>\n\n\n\n<p>It is sometimes referred to as an EHC plan.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"entitle\"><strong>What does an EHCP entitle you to?<\/strong><\/h3>\n\n\n\n<p>Your child\u2019s EHCP will outline their needs, and what specific support they would benefit from. This is called the \u201cprovision\u201d.&nbsp;<\/p>\n\n\n\n<p>Your local authority has a responsibility to make sure children with EHCPs are receiving the provision set out in their EHCP.<\/p>\n\n\n\n<p>What provision your child is entitled to will depend on what they need.&nbsp;<\/p>\n\n\n\n<p>Their EHCP might recommend support such as:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-primary-bullets\">\n<li>Enrolment in a special school.<\/li>\n\n\n\n<li>Speech and language therapy.&nbsp;<\/li>\n\n\n\n<li>Physiotherapy.<\/li>\n\n\n\n<li>One-to-one teaching support.<\/li>\n\n\n\n<li>Specialist technology or software.&nbsp;<\/li>\n<\/ul>\n\n\n\n  <div class=\"wp-block  box    is-style-textured-grey-tint-10\">    <div class=\"acf-innerblocks-container\">\n\n<h2 class=\"wp-block-heading\" id=\"stages\"><strong>What are the five stages of an EHCP?<\/strong><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Stage one: Identifying needs<\/strong><\/h3>\n\n\n\n<p>The first stage in getting an EHCP is identifying that a child has special educational needs that can\u2019t be met by their school\/nursery\/college.<\/p>\n\n\n\n<p>If the young person needs more learning support, and their needs can;t be met by the educational support currently on offer, then an EHCP assessment may be requested.<\/p>\n\n\n\n<p>This can be requested by parents, carers, professionals or by the young person themselves if they are aged 16-25.&nbsp;<\/p>\n\n\n\n<p><a href=\"https:\/\/www.sense.org.uk\/information-and-advice\/life-with-complex-disabilities\/childhood-and-school\/send-education-special-education-needs-disabilities\/education-health-and-care-plans\/requesting-an-education-health-and-care-plan-ehcp\/\">Find out more about how to request an EHCP assessment as a parent.<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Stage two: Assessment<\/strong><\/h3>\n\n\n\n<p>In this stage, the local authority will carry out an EHCP assessment to determine whether the child needs an EHCP.<\/p>\n\n\n\n<p><a href=\"#assessments\">Find out more about EHCP assessments.<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Stage three: Planning<\/strong><\/h3>\n\n\n\n<p>If the assessment finds that a young person needs an EHCP, the next stage is to create the plan.<\/p>\n\n\n\n<p>The local authority will use evidence and advice from professionals involved in a child\u2019s care to help them draft a plan for that child\u2019s support.&nbsp;<\/p>\n\n\n\n<p><a href=\"#looks-like\">Find out more about what\u2019s in an EHCP.<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Stage four: Implementing the plan<\/strong><\/h3>\n\n\n\n<p>Once the plan has been created and finalised, it should be put into action.&nbsp;<\/p>\n\n\n\n<p>There should be clear communication between educational professionals and parents about how this is being done.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Stage five: Reviewing the plan<\/strong><\/h3>\n\n\n\n<p>EHCPs must be reviewed every year. The first review should happen within 12 months of the plan being finalised.&nbsp;<\/p>\n\n\n\n<p><a href=\"#reviews\">Find out more about EHCP reviews.<\/a><\/p>\n\n<\/div>\n  <\/div>\n\n\n\n\n<h2 class=\"wp-block-heading\" id=\"need\"><strong>Does my child need an EHCP?<\/strong><\/h2>\n\n\n\n<p>Your child may need an EHCP if they need more support than their school or educational setting can offer them.&nbsp;<\/p>\n\n\n\n<p>To get one, you will need to show that:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-secondary-bullets\">\n<li>Your child is struggling at school\/nursery\/college due to their unmet needs, and<\/li>\n\n\n\n<li>Their school\/nursery\/college is unable to meet their needs.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>Although the EHCP can include health or social care needs, your child will not get an EHCP if their needs do not affect their education.<\/p>\n\n\n\n<p>To find out if your child can get an EHCP, they\u2019ll need to have an EHCP assessment. Find out more about EHCP assessments.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"diagnosis\"><strong>Does my child need a diagnosis to get an EHCP?<\/strong><\/h3>\n\n\n\n<p>Your child doesn\u2019t need to have a medical diagnosis to get an EHCP.<\/p>\n\n\n\n<p>You just need to show that your child\u2019s needs are not being met, and they need more support than their school\/nursery\/college can offer.&nbsp;<\/p>\n\n\n\n<p>This will need to be shown at an EHCP assessment.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"assessments\"><strong>EHCP assessments<\/strong><\/h2>\n\n\n\n<p>You can ask <a href=\"https:\/\/www.gov.uk\/find-your-local-council\">your local authority<\/a> to carry out an assessment if you think your child needs an EHCP.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"what-is-assessment\"><strong>What is an EHCP assessment?<\/strong><\/h3>\n\n\n\n<p>An EHCP assessment or EHC needs assessment is an assessment of what a young person needs, in terms of education, health and social care.&nbsp;<\/p>\n\n\n\n<p>EHCP assessments are carried out by the local authority.&nbsp;<\/p>\n\n\n\n<p>The local authority may ask for information from:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-primary-bullets\">\n<li>Parents\/carers.<\/li>\n\n\n\n<li>Teachers.<\/li>\n\n\n\n<li>Doctors.<\/li>\n\n\n\n<li>Educational psychologists.&nbsp;<\/li>\n\n\n\n<li>Social services.<\/li>\n\n\n\n<li>Therapists (such as physiotherapists, occupational therapists).<\/li>\n<\/ul>\n\n\n\n<p>You can also proactively gather this information yourself to make sure the local authority considers it. For example, you might ask a play worker from Sense who knows you well to provide evidence.<\/p>\n\n\n\n<p>The local authority uses the information gathered to decide whether the child needs an EHCP.&nbsp;<\/p>\n\n\n\n<p>If it\u2019s decided that your child needs an EHCP, the local authority must then provide one.&nbsp;<\/p>\n\n\n\n<p><a href=\"https:\/\/www.ipsea.org.uk\/what-happens-in-an-ehc-needs-assessment\">Visit the IPSEA website for more detail about what happens during an EHCP assessment.&nbsp;<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"who\"><strong>Who can ask for an EHCP assessment?<\/strong><\/h3>\n\n\n\n<p>EHCP assessments can be requested by:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-secondary-bullets\">\n<li>Parents\/carers.<\/li>\n\n\n\n<li>Education professionals (such as teachers, SENCos).&nbsp;<\/li>\n\n\n\n<li>Healthcare professionals (such as doctors, health visitors).<\/li>\n\n\n\n<li>The young person themselves (if aged 16-25).<\/li>\n\n\n\n<li>Anyone else who is involved with the young person and cares about their needs.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p><a href=\"https:\/\/www.sense.org.uk\/information-and-advice\/life-with-complex-disabilities\/childhood-and-school\/send-education-special-education-needs-disabilities\/education-health-and-care-plans\/requesting-an-education-health-and-care-plan-ehcp\/\">Find out more about requesting an EHCP assessment as a parent.<\/a><\/p>\n\n\n\n<div class=\"wp-block  slab    is-style-textured-secondary-tint-10  align-full\">\n  <div class=\"wrap\">  <div class=\"acf-innerblocks-container\">\n\n<h2 class=\"wp-block-heading\" id=\"look-like\">What does an EHCP look like?<\/h2>\n\n\n\n<p>An EHCP is made up of 12 sections, detailing the young person\u2019s needs and ideal outcomes.&nbsp;&nbsp;&nbsp;<\/p>\n\n\n\n<p>There is no national standard for how these sections are presented &#8211; it is up to each local authority. But the sections must be clearly labelled.&nbsp;<\/p>\n\n\n\n<p>The 12 sections of an EHCP are:<\/p>\n\n\n\n<p><strong>A.<\/strong> The views, interests and aspirations of you and your child.<br><strong>B.<\/strong> Special educational needs.<br><strong>C.<\/strong> Health needs related to special educational needs.<br><strong>D.<\/strong> Social care needs related to special educational needs.<br><strong>E.<\/strong> Outcomes \u2013 how the extra help will benefit your child.<br><strong>F.<\/strong> Special educational provision (support).<br><strong>G.<\/strong> Health provision.<br><strong>H.<\/strong> Social care provision.<br><strong>I.<\/strong> Placement \u2013 type and name of school or other institution (blank in the draft plan).&nbsp;<br><strong>J. <\/strong>Personal budget arrangements.<br><strong>K.<\/strong> Advice and information \u2013 a list of the information gathered during the education, health and care needs assessment.<\/p>\n\n<\/div>\n  <\/div>\n<\/div>\n\n\n\n  <div class=\"wp-block  box    is-style-textured-grey-tint-10\">    <div class=\"acf-innerblocks-container\">\n\n<h3 class=\"wp-block-heading\" id=\"examples\"><strong>EHCP examples<\/strong><\/h3>\n\n\n\n<p>The following are some EHCP examples provided by local authorities around England:<\/p>\n\n\n\n<p><a href=\"https:\/\/www.swindon.gov.uk\/download\/downloads\/id\/9405\/exemplar_2_ehc_plan_-_february_2020.pdf\">Swindon Borough Council &#8211; example EHCP<\/a><\/p>\n\n\n\n<p><a href=\"https:\/\/www.cumbria.gov.uk\/elibrary\/Content\/Internet\/537\/6381\/6424\/6865\/7024\/4278773238.pdf?timestamp=433409599\">Cumbria County Council &#8211; EHCP examples of good practice<\/a><\/p>\n\n\n\n<p><a href=\"https:\/\/www.enfield.gov.uk\/__data\/assets\/pdf_file\/0015\/5640\/exemplar-lb-enfield-ehcp-local-offer.pdf\">Enfield Council &#8211; exemplar EHCP template<\/a><\/p>\n\n<\/div>\n  <\/div>\n\n\n\n\n<h2 class=\"wp-block-heading\" id=\"what-school\"><strong>If my child gets an EHCP, what school or college can they go to?<\/strong><\/h2>\n\n\n\n<p>If your child has an EHCP, they can go to a <a href=\"https:\/\/www.sense.org.uk\/information-and-advice\/life-stages\/childhood-and-school\/send\/support-in-schools\/\">mainstream school or a SEN school<\/a> (or <a href=\"https:\/\/www.sense.org.uk\/information-and-advice\/life-stages\/childhood-and-school\/send\/post-16\/\">sixth form or further education college<\/a>), depending on their needs.<\/p>\n\n\n\n<p>In SEN schools, sometimes called special schools, there are only pupils with SEND, usually with complex needs.<\/p>\n\n\n\n<p>SEN schools usually have specially trained teachers, therapists and special equipment to support pupils\u2019 needs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"refuse\"><strong>Can a school refuse a child with an EHCP?<\/strong><\/h2>\n\n\n\n<p>An EHCP is a legal document, which means that the school named in it must legally accept your child and offer them the support outlined in the EHCP.&nbsp;<\/p>\n\n\n\n<p>If your child\u2019s school is refusing to take them, despite being named in their EHCP, you should speak to your local authority and seek legal advice.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"grounds\"><strong>On what grounds can a school refuse a child with an EHCP?<\/strong><\/h3>\n\n\n\n<p>In some exceptional circumstances, schools may be able to refuse children with an EHCP (for example, if the child\u2019s health and safety would be at risk).<\/p>\n\n\n\n<p>These decisions are rare, and should only be made when the school has explored every alternative.&nbsp;<\/p>\n\n\n\n<p>If you find yourself in this situation, it is recommended to seek legal advice.&nbsp;<\/p>\n\n\n\n<p><a href=\"https:\/\/www.ipsea.org.uk\/Pages\/Category\/service-overview\">Get information and support from IPSEA to help understand your child\u2019s rights.<\/a><\/p>\n\n\n\n<p><a href=\"https:\/\/www.sense.org.uk\/information-and-advice\/life-stages\/childhood-and-school\/send\/ehcp-appeal\/\">Find out more about appeals and tribunals.&nbsp;<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"how-long\"><strong>How long does an EHCP last?<\/strong><\/h2>\n\n\n\n<p>An EHCP stays in place until your child leaves education, or the local authority decides that your child no longer needs the EHCP to help them in their education.&nbsp;<\/p>\n\n\n\n<p>If you move to another local authority, the EHCP should be transferred.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"reviews\"><strong>EHCP reviews<\/strong><\/h2>\n\n\n\n<p>An EHCP should be reviewed at least once a year (annually).&nbsp;<\/p>\n\n\n\n<p>Your child\u2019s first annual review should take place within 12 months of first getting the EHCP.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"involved\"><strong>What is involved in an EHCP review?<\/strong><\/h3>\n\n\n\n<p>The annual review is a formal process that follows specific legal requirements, including a formal meeting.<\/p>\n\n\n\n<p>The local authority is responsible for annual reviews, but it is usually the school that organises the review meeting.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>Before your EHCP review<\/strong><\/h4>\n\n\n\n<p>Everyone who needs to be at the review should be given two weeks\u2019 notice of the meeting.<\/p>\n\n\n\n<p>They should all send in reports of how your child is getting on, which everyone should see before you all meet.<\/p>\n\n\n\n<p>This information gathering stage is really important, especially if you and your family want changes to your EHCP.<\/p>\n\n\n\n<p>The following people should all be invited:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-primary-bullets\">\n<li>Parents or caregiver.&nbsp;<\/li>\n\n\n\n<li>If your child is 16 or over, the invitation to the meeting should go to them.<\/li>\n\n\n\n<li>Someone from your child\u2019s school or college.<\/li>\n\n\n\n<li>Local authority officer for education.<\/li>\n\n\n\n<li>Local authority officer for social care.<\/li>\n\n\n\n<li>A healthcare professional.<\/li>\n\n\n\n<li>Anyone else who\u2019s relevant, such as a job coach.<\/li>\n<\/ul>\n\n\n\n<p>It\u2019s a good idea to prepare notes before the meeting, setting out anything you think needs to change.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>In the EHCP review<\/strong><\/h4>\n\n\n\n<p>In the review, you\u2019ll all talk through your child\u2019s progress and anything they need to support their goals.<\/p>\n\n\n\n<p>If outcomes have been achieved or need to be changed, new outcomes should be chosen. It\u2019s important a detailed record of the discussion is kept.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>After the EHCP review<\/strong><\/h4>\n\n\n\n<p>Everyone who came to the meeting or supplied information will receive a copy of the notes.<\/p>\n\n\n\n<p>Then the local authority will review your plan and tell you what they\u2019ve decided within four weeks of the meeting.<\/p>\n\n\n\n<p>They may decide to either:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-secondary-bullets\">\n<li>Change the EHCP.<\/li>\n\n\n\n<li>Leave the EHCP as it is.&nbsp;<\/li>\n\n\n\n<li>Stop the EHCP.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>At this stage, you will have around 15 days to make comments or ask for changes. This is called \u2018making representations\u2019.<\/p>\n\n\n\n<p>If your child is moving to a new place of education, at this stage you can also name the school or college you want them to attend.<\/p>\n\n\n\n<p>Within eight weeks of sending the draft plan, you should receive the final EHCP from the local authority, or a decision not to amend it.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"end\"><strong>When does an EHCP end?<\/strong><\/h2>\n\n\n\n<p>An EHCP will stop in one of two situations:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>When the local authority is no longer responsible for your child.<\/li>\n\n\n\n<li>If your child\u2019s needs change so they don\u2019t need an EHCP any more.<\/li>\n<\/ol>\n\n\n\n<p>Your local authority is no longer responsible when your child:<\/p>\n\n\n\n<ul class=\"wp-block-list is-style-primary-bullets\">\n<li>Starts working.<\/li>\n\n\n\n<li>Goes to university.&nbsp;<\/li>\n\n\n\n<li>Leaves education completely.&nbsp;<\/li>\n\n\n\n<li>Turns 25 years old.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"move\"><strong>What happens to an EHCP if you move?<\/strong><\/h3>\n\n\n\n<p>If you move to a different local authority with an EHCP, your EHCP should be transferred to the new local authority.&nbsp;<\/p>\n\n\n\n<p>You should give your local authority at least 15 working days\u2019 notice that you are moving.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"over-18\"><strong>If you are over 18 with an EHCP<\/strong><\/h2>\n\n\n\n<p>EHCPs can continue up to the age of 25, as long as you still have SEND and are still in education or training.&nbsp;<\/p>\n\n\n\n<p>Your local authority shouldn\u2019t take away your EHCP just because you are over 18. They also shouldn\u2019t insist you work towards qualifications, employment or independent living.<\/p>\n\n\n\n<p>Your outcomes may be different and you should still be able to have
